Statistical agencies must broaden who can use data they get under this law so researchers can build evidence. They must do this while keeping the data safe from improper access and use. The rules for how to do this will come from the Director. The Director must create clear rules that tell agencies how to rate each data asset for sensitivity and who can access it. The rules must set common sensitivity levels (with a required minimum and maximum), say how to choose a level, and say when a less sensitive version can be made. The rules must explain how to remove or hide information so people can’t be identified. Agencies must run a full risk check before any data is released to the public and use set criteria to decide whether to release it. Agencies must be transparent: they must post sensitivity ratings, risk assessments, and related policies on the Federal data catalogue (section 3511(c)(1)) and on their websites. The Director must publish all these standards and make sure agencies can post the information on the Federal data catalogue.
