Title 45 › Chapter CHAPTER 19— - ROCK ISLAND RAILROAD EMPLOYEE ASSISTANCE › § 1004
Gives first hiring rights to people who worked for the Rock Island Railroad on August 1, 1979 and who were laid off or furloughed (not for cause) before January 1, 1984 because the railroad cut service. They have priority for hiring by any other rail carrier regulated by the Commission, unless they are less qualified than other applicants or the job is reserved under an affirmative action plan required by federal or state law, regulation, Executive Order, or a court or agency order, or under a permitted voluntary affirmative action plan. A carrier recalling its own furloughed workers is not treated as hiring new employees. These rights are the same as those given to employees of the Chicago, Milwaukee, Saint Paul and Pacific Railroad under section 907.
