Railroad lands that belong to the Alaska Railroad cannot be picked, claimed, or given away under most Alaska land laws, except for one specific exception in section 12(b)(8)(i)(D) of the 1976 Act (as amended). The Secretary of the Interior, Village Corporations with claims, and the State must try to review and settle claims during the ten months after January 14, 1983. Any settlement only becomes binding for the United States, the State, and a Village Corporation when the railroad is actually transferred. After the review, the Secretary must write a report listing lands to be conveyed under those settlements. The Secretary must finish final administrative decisions on unresolved claims no later than three years after January 14, 1983, and must finish surveys of all lands to be conveyed no later than five years after January 14, 1983, after talking with the Governor about survey priorities. The Secretary must give Village Corporation claims priority and, for lands not settled, must finish final decisions within two years after January 14, 1983. While claims are pending, those lands must be managed under a written agreement among the Federal Railroad Administration, the State, Eklutna, Cook Inlet Region, and Toghotthele; copies are kept in Washington, D.C., and Juneau. The Secretary may accept Village Corporations’ voluntary surrender of claims in the railroad right-of-way, and if they do not surrender, the Secretary will convey the United States’ right in the right-of-way to the State free of those claims. Final administrative decisions can only be reviewed in the U.S. District Court for the District of Alaska, and no court or agency action may stop the railroad transfer or hurt railroad operations. The State must pay for damage if it uses licensed railroad land in ways the license does not allow.
