If the Secretary does not certify that the State met the conditions in section 1203 within one year after the report under section 1204(a), the Secretary may sell or transfer Alaska Railroad property. Any sale must favor a buyer who will keep running rail service, but it cannot reduce Cook Inlet Region, Incorporated’s rights under section 12 of the Act of January 2, 1976 (Public Law 94–204; 89 Stat. 1150), as amended by section 606(d), or change the Secretary’s or State’s consent powers under section 12(b)(8), as amended by section 606(d)(5).
