Controlled carriers must not set or use prices, fees, or rules in published price lists or service contracts that let cargo be moved for less than a fair and reasonable amount. They also must not keep rules or classifications that would likely cause that to happen. The Federal Maritime Commission can, after giving notice and holding a hearing, ban any price, fee, rule, or classification if the carrier cannot show it is fair. The carrier has to prove its price or rule is fair. Any banned or suspended price or rule is void and illegal to use.
