The United States Merchant Marine Academy must have at least 1 full-time sexual assault response coordinator (SARC) who lives at or near the Academy. The Secretary of Transportation can add more SARCs if needed. SARCs must be chosen for experience helping victims of sexual harassment, dating violence, domestic violence, sexual assault, and stalking, and for being able to give protected, confidential help. SARCs must give private help to cadets who report or witness those crimes. The Maritime Administrator must make a way to check that SARCs get proper training within 90 days after the National Defense Authorization Act for Fiscal Year 2018 became law. That training must cover working with victims, the Academy’s policies and resources, and national, State, and local victim services. SARCs must finish the training within 270 days after that law or within 180 days after they start the job. SARCs must take reports in private, tell victims their rights and reporting choices, explain available services and housing or other accommodations, help arrange services or accommodations if the victim agrees, represent the victim’s interests even if those differ from the Academy’s, give written info, and keep the victim’s information confidential unless the law requires disclosure, the victim asks after being fully informed, or there is imminent danger. SARCs must help victims report to the Academy or police if the victim asks and must send an annual report to the Director of the Maritime Administration Office of Civil Rights about resources used and how many victims were helped. SARCs report directly to the Superintendent and also to Maritime Administration leadership on certain matters. Asking for accommodations will not automatically start an investigation. SARCs, victim advocates, or companions cannot be punished for supporting a victim. The Secretary must name a lawyer called the Special Victims Advisor to give legal help to cadet victims; those talks are protected like attorney‑client communications. The Secretary must also pick volunteer victim advocates from Academy staff, train them, and have at least one advocate or a SARC act as a companion to guide victims through investigations, medical care, and recovery. The Maritime Administrator may hire these people without following some usual federal hiring rules.
