By January 1, 2023, the Maritime Administrator must create an information system inside the United States Merchant Marine Academy Sexual Assault Prevention and Response Program to track cadet sexual assault and sexual harassment incidents that must be reported under current rules. The system must record, when available, yearly totals, where each incident happened (including vessel name and company), job titles of people involved, a simple description and any reports, what type of inquiry was done, and whether the incident was found to be true. The system must include relevant older data too. It must be kept secure, protect privacy, and avoid keeping personal details unless needed for statistics. If a final agency action or final judgment clears someone, their personal information must be removed. Ninety days after the system starts, the Department of Transportation’s Office of Inspector General must audit its cybersecurity and report the results to the Senate Committee on Commerce, Science, and Transportation and the House Committee on Transportation and Infrastructure. The Maritime Administrator must also set up confidential in-person and virtual exit interviews, run by staff who did not assign midshipmen to Sea Year vessels, for midshipmen after Sea Year and after they finish the required survey. Data from the system and these interviews must be used to make or change policies about sexual harassment, dating or domestic violence, sexual assault, and stalking.
