The Secretary of Transportation can insure or reinsure ships, cargo, and related losses under this law. That includes American ships (even ones being built); some foreign ships if a U.S. citizen owns them or if they are working in U.S. trade or doing water services the Secretary thinks help national defense or the U.S. economy; cargo moved on such ships or owned by U.S. citizens or residents; cargo traded under contracts that make a U.S. person bear war risk; and cargo moved between U.S. ports. It also covers payments and expenses tied to the ship (like advances to the captain and shared-loss costs), passengers’ personal belongings, loss of life, injury, or capture by an enemy, and the usual legal or contractual liabilities that insurance normally covers. When thinking about insuring a foreign ship, the Secretary must look at the ship’s features, how it is used, and how its owner or charterer manages it. Coverage for personal items, death, injury, capture, and related liabilities can include non-war risks if the Secretary decides that is appropriate.
