The Secretary of Transportation may buy or sell reinsurance with an insurance company licensed in a U.S. state for policies the Secretary issues under this chapter. The Secretary must not sell reinsurance for less, or buy it for more, than the better of: the Secretary’s rate for similar risks or the company’s rate for the same policy. The Secretary may pay a reasonable fee for services and facilities the company provides, but not for selling or promoting insurance.
