The Secretary of Transportation can run the program like a private marine insurer. The Secretary may write rules, set and change forms, insurance amounts, and premium rates, and charge an annual fee to cover application and underwriting costs. The Secretary can pay claims and court judgments related to this insurance. The Secretary may hire a U.S. marine insurance company as an underwriting agent and should do so when it makes sense. The agent can help handle claims, but payments need the Secretary’s approval. The agent can be paid reasonable fees and expenses, but not for finding customers. Brokers cannot be paid for arranging insurance when the government directly covers a risk. The Secretary may hire marine insurance experts outside normal federal hiring rules and may use other agencies’ people and resources with their agreement. The Secretary can also require insured vessels to report their location.
