Railroad cars or motor vehicles, with their driver, passengers, or cargo, do not have to follow the rule when they are carried on a railroad car ferry between fixed Great Lakes terminals as part of a rail route, as long as four conditions are met. The ferry must be owned by a water carrier and run as part of a rail route with the Surface Transportation Board’s approval; the ferry owner or its predecessor must have been owned or controlled by a rail carrier before June 5, 1920; the ferry owner’s stock must now be owned or controlled by a rail carrier with the Board’s approval; and the ferry must have been built in and registered under U.S. law.
