A legal claim on a ship does not stop the government from taking the ship. If claims exist, the Secretary of Transportation can put part of the payment into a fund in the Treasury, but not more than the combined amount of those claims. The Secretary must announce the fund in the Federal Register. Money in that fund can be used to pay the compensation or any claims that were on the ship when it was taken, including claims decided by a court. People who hold claims have 6 months after the notice to sue the fund in admiralty. They must file in the U.S. district court where the ship was taken from custody or where it was located when taken. They must serve the U.S. Attorney, the Attorney General, and the Secretary the way the Federal Rules of Civil Procedure require. The court will tell other interested people and decide the case using the same law and procedures as similar private disputes.
