Title 46 › Subtitle Subtitle V— - Merchant Marine › Part Part F— - Government-Owned Merchant Vessels › Chapter CHAPTER 571— - GENERAL AUTHORITY › § 57104
The Secretary of Transportation may buy suitable documented ships using money in the Vessel Operations Revolving Fund that came from selling old ships in the National Defense Reserve Fleet. Both the ships bought and the ones sold must be valued at scrap market value on the date of transfer, using the same method and taking into account fair costs to move a sold ship to the scrapyard. Lay-up costs for a ship bought this way may be paid from the Fund. A ship sold from the Fleet can be scrapped in an approved foreign market without extra approval to transfer it to a non‑U.S. person.
