The Secretary can act to stop or prevent harm to bridges, piers, and other structures in or on U.S. navigable waters, nearby land or shore areas, and the waters themselves. That includes damage from cyber attacks, organized crime that crosses borders, or threats from foreign governments. To do this, the Secretary can make rules about handling and moving explosives, oil, and hazardous materials (as defined in section 2101); require minimum safety equipment for structures; create water or waterfront safety zones to limit access; set up inspection procedures; and bar representatives of governments listed under section 620A of the Foreign Assistance Act of 1961 (22 U.S.C. 2371) from visiting facilities that must have a facility security plan under section 70103(c). States and local governments may set stricter safety equipment or safety standards than these federal rules.
