Whether the United States has authority over a covered vessel is not part of proving the crime. Questions about that authority are legal matters the judge decides before trial. People who violate sections 70503 or 70508 must be tried where the offense happened, or in any district if it began on the high seas or outside any State’s or district’s jurisdiction.
