The Federal Communications Commission (FCC) must start a rulemaking within one year after February 22, 2012 to consider letting unlicensed U–NII devices use the 5350–5470 MHz band. The FCC can only make that change after consulting with the Assistant Secretary and finding that licensed users will be protected by technical sharing methods (including things like dynamic frequency selection) and that Federal users’ main missions in the 5350–5470 MHz band will not be harmed. The Assistant Secretary must study known and proposed sharing technologies and the risk to Federal users if unlicensed U–NII devices used the 5350–5470 MHz and 5850–5925 MHz bands. A report on 5350–5470 MHz is due within 8 months after February 22, 2012, and a report on 5850–5925 MHz is due within 18 months after that date. Definitions: 5350–5470 MHz band = 5350 to 5470 megahertz; 5850–5925 MHz band = 5850 to 5925 megahertz.
