People in the United States must not be kept out of, denied benefits of, or treated unfairly in any program or activity that gets money under this part because of their actual or assumed race, color, religion, national origin, sex, gender identity, sexual orientation, age, or disability. The Assistant Secretary must enforce that rule by writing rules and acting under section 2000d–1 of title 42. Courts can review those actions as allowed by section 2000d–2 of title 42. The Assistant Secretary must, when possible, carry out these programs in a technology-neutral way. Starting in the first fiscal year money is used under this part, and in each of the next 4 fiscal years, up to $1,000,000 each year may be appropriated to the Office of Inspector General for the Department of Commerce for audits and oversight of these funds, and those amounts remain available until spent.
