Title 47 › Chapter CHAPTER 5— - WIRE OR RADIO COMMUNICATION › Subchapter SUBCHAPTER III— - SPECIAL PROVISIONS RELATING TO RADIO › Part Part I— - General Provisions › § 317
Radio stations must say on the air when something they broadcast was paid for or provided because of payment. That includes money, services, or other value. Items given free or for a tiny price don’t count unless they were given in return for a special on-air identification beyond what is reasonably needed to use the item. The Commission can also require announcements for political or controversial programs when materials or services (like recordings, scripts, or talent) were supplied free or cheaply to get the program aired. If a report is made under section 508 about a situation that would have required an announcement, the station must announce it. The station’s licensee must try to get the needed information from employees and people who work with the station so the announcement can be made. The Commission can waive the announcement rule when the public interest does not require it, and must make rules to carry out these requirements.
