The United States must give nonreimbursable technical help and training under sections 222 and 224 of the 2023 Amended U.S.-RMI Compact. This can include training and equipment for postal inspection of illegal drugs and other contraband. The help is to let the Republic of the Marshall Islands (RMI) make and enforce its own laws and to work with the United States to enforce U.S. criminal laws. Money appropriated under subsection (j) of section 1921d may be used as allowed by section 1921b(a). Congress also confirms earlier laws saying the Section 177 Agreement is the final settlement of the claims in Articles X and XI, and that Article XII’s limits only clarify Article X. The 2023 amendment does not change those points. Two U.S. voting members on the Joint Economic Management and Financial Accountability Committee must be federal employees, serve 2-year terms, and be appointed by the Secretaries of State and Interior (each consulting the Secretary of the Treasury). One may be reappointed up to two times. At least one U.S. member must have special qualifications and at least 5 years’ full-time experience. The Secretary of the Interior must notify Congress within 90 days of appointments and send Committee reports to Congress within 90 days after they are received or completed. Similar rules apply to the Trust Fund Committee, which has three U.S. voting members appointed by the Secretaries of State, Interior, and Treasury, serving terms up to 5 years, with reappointment limits and at least two qualified members with 5 years’ experience. Congress reaffirms that certain health and aid programs apply only to people from Bikini, Enewetak, Rongelap, and Utrik affected by U.S. nuclear testing under Public Law 95–134 and Public Law 96–205, that unspent funds must return annually to the Fund Manager, and that after 15 years the Fund Manager will make annual disbursements to continue health services. On request of the RMI, the President must continue special medical care and support for remaining Rongelap and Utrik residents exposed in the 1954 “Bravo” test. For the first 15 years after the Compact’s effective date, the U.S. must, on RMI request, provide unpaid technical help for planting, food programs, and water transport for the named atolls; the Secretaries of the Interior and Agriculture may provide grants and food programs as described.
