People hurt because a carrier or broker that must follow rules under chapter 135 ignores an order or breaks certain rules can sue in court to enforce the order or get an injunction for violations of sections 14102, 14103, and 14915(c). Carriers or brokers are responsible for harm they cause by breaking these rules. A carrier must also pay back any charges that are higher than the tariff rate listed under section 13702. A person can first file a complaint with the Board or the Secretary under section 14701(b) or go straight to court to make the carrier pay. If the Board or Secretary orders money, they will set a payment date. They can order money only after a complaint proceeding. If the carrier misses the payment date, the person the order helps can sue to enforce it and must include the Board’s or Secretary’s order in the court papers. Federal district courts and state courts of general jurisdiction can hear these cases. The Board’s or Secretary’s findings count as evidence. Cases go to the district where the plaintiff lives or where the carrier’s main office is. Multiple winners or carriers can be joined in one case. The court must award a reasonable lawyer’s fee and add it to the case costs.
