If someone provides motor vehicle transportation or service that clearly breaks sections 13901–13904 or 13906, a person hurt by that service may sue to enforce those rules. The trial must be in the federal court district where the person who broke the rule operates. A copy of the complaint must be given to the Secretary, and the complaint filed in court must say the Secretary was served. The Secretary may join the case or tell the court it will handle the same matter in its own proceeding; if the Secretary does that, the court must pause the lawsuit until the Secretary finishes. The court may order the losing side to pay a reasonable lawyer’s fee to the winner, plus any court costs allowed under the Federal Rules of Civil Procedure.
