By February 15 each year, Amtrak must send two reports. One goes to Congress and must list, for every route it ran in the prior fiscal year, basic route numbers (like riders and passenger‑miles), the short‑term avoidable profit or loss per passenger‑mile, revenue‑to‑cost ratio, revenues, the federal subsidy and any nonfederal subsidy, on‑time performance, and any changes to frequency or station stops. That report must also say if Amtrak decided to pay any officer more than the rate for level I of the Executive Schedule under section 5312 of title 5, list major operational problems Amtrak finds, and describe Amtrak’s proposals to fix them. The independent certified public accountant’s annual audit of Amtrak’s financial statements must be done under usual auditing standards and included with this report. By February 15 each year Amtrak must also give the President and Congress a complete report on its operations, activities, accomplishments, and finances for the prior fiscal year. That report must discuss progress on the goal in section 24902(a), may recommend needed laws or funding amounts and methods, include the category in section 24319(c)(2)(C), and must include an action plan and status reports to bring Amtrak‑served stations into compliance with the Americans with Disabilities Act under the 2020 settlement with the Department of Justice. Amtrak may file extra reports at other times. The Secretary of Transportation must include a report on how well this part works for a balanced transportation system in the Secretary’s annual report under section 308(a). The Comptroller General may do performance audits and set rules for them. Amtrak and any contracted rail carrier must give auditors all needed records and access. The Comptroller General must send audit reports and recommendations to Congress and also to the President, the Secretary, and Amtrak. A State may view Amtrak records used to decide any payment the State must make.
