When a Virginia public commuter authority signs a contract agreeing to cover Amtrak or a railroad for its commuter operations, any claims from an accident or incident in Washington, D.C. tied to those operations cannot be larger than the authority’s insurance limits that cover that promise, including punitive damages. The authority must keep at least $200,000,000 in total liability coverage. This rule only applies after Amtrak or a railroad that wants the indemnity signs a deal letting the authority use its property or tracks for revenue passenger service related to the authority’s operations.
