Allows certain foreign-made vehicles to be brought into the United States if they can meet U.S. safety rules. The Transportation Secretary (on their own or after a petition from a maker or registered importer) can decide a vehicle is okay if it is very similar to a U.S. model, already certified under the right U.S. rules, is the same model year, and can be easily changed to meet safety standards. If no similar U.S. model exists, the Secretary can allow import if crash tests or other evidence show the vehicle’s safety parts meet or can be made to meet the standards. The car must be brought in by a registered importer who pays an annual fee and any other fees set to cover processing bonds and decision costs. The Secretary must make clear rules for these decisions and for registering importers, including recordkeeping, inspections, and proof that the importer can meet legal and financial duties. The Secretary will give public notice and consider test data and maker information. If a decision is negative, it cannot be reviewed again for the same model for at least 3 calendar months. The Secretary will publish decisions each year; a positive decision applies to that model and lets other registered importers bring in the same model under the decision’s terms. Importers must post a bond with the U.S. Treasury to guarantee the vehicle will be fixed to meet standards within a set time or will be exported or abandoned. The bond must be at least the vehicle’s dutiable value but no more than 150 percent of that value. Fees must be reviewed and adjusted at least every 2 years and set before each fiscal year; collected fees may only be used for carrying out these import and related enforcement tasks and to reimburse the Treasury.
