Courts can review in the same way any action by the Secretary of Transportation, or by the heads of the Federal Railroad Administration (FRA), the Federal Motor Carrier Safety Administration (FMCSA), or the Federal Aviation Administration (FAA), when they carry out duties moved or given to them by the Department of Transportation Act (Public Law 89–670). Any existing rules about notice, a chance for a hearing, decisions based on the official record, or administrative review still apply. This does not cover duties moved from the Interstate Commerce Commission under section 6(e)(1)–(4) and (6)(A).
