The Secretary of Transportation sets how long an airline permit lasts and can change, limit, suspend, or cancel a permit after giving notice and a chance for a hearing if doing so is in the public interest. With the President’s approval and without a hearing, the Secretary can immediately suspend or limit permits for foreign carriers when it is in the public interest and a foreign government, its aviation authority, or a foreign carrier has, against U.S. objections, denied U.S. carriers rights or used unfair or discriminatory practices that hurt competition. The Secretary must quickly review a foreign carrier that breaks U.S. drug‑import laws or fails to take available steps to stop illegal drug importation on its planes and may then change, suspend, or revoke its permit. Anyone with an interest can file a response supporting or opposing permit changes under the normal process.
