The TSA Administrator can authorize a state or local police officer to do federal airport security work. To do that, TSA must have a voluntary agreement with the officer’s agency. A deputized officer counts as a federal law enforcement officer for the rules that require federal officers, and while doing those duties they work under federal supervision and control and are treated as a federal employee for 28 U.S.C. 1346(b), 2401(b), and chapter 171. TSA must repay the agency for all reasonable costs that are allowed and can be charged to the deputized officer, and Congress may provide the needed funding. TSA may place these officers away from the screening area if they can still respond quickly to problems at the screening site.
