§6105 Implementation of best practices guidelines

Summary

The Secretary of Transportation must urge states, one-call program operators, all excavators (including government and contract crews), and underground utility owners to use the best practices in the report "Common Ground" as it is updated. The Secretary must also give technical help and take part in programs run by a nonprofit set up to reduce construction damage to underground facilities and may give grants to that nonprofit. In addition to amounts under section 6107, Congress authorized $500,000 for each of fiscal years 2003 through 2006 for these grants. The money stays available until spent and must come from general revenues, not from amounts collected under section 60301.

(a)The Secretary of Transportation shall encourage States, operators of one-call notification programs, excavators (including all government and contract excavators), and underground facility operators to adopt and implement practices identified in the best practices report entitled “Common Ground”, as periodically updated.
(b)The Secretary shall provide technical assistance to and participate in programs sponsored by a non-profit organization specifically established for the purpose of reducing construction-related damage to underground facilities.
(c)(1)The Secretary may make grants to a non-profit organization described in subsection (b).
(2)In addition to amounts authorized under section 6107, there is authorized to be appropriated for making grants under this subsection $500,000 for each of fiscal years 2003 through 2006. Such sums shall remain available until expended.
(3)Any sums appropriated under this subsection shall be derived from general revenues and may not be derived from amounts collected under section 60301.
