A court can order a carrier to give the goods to someone when the negotiable bill is lost, stolen, or destroyed, if that person posts a court-approved bond to protect the carrier and others from claims tied to the missing original bill. The court can also order payment of reasonable costs and lawyer fees. A bond given voluntarily, without a court order, is still binding on the people who signed it. Giving the goods under a court order does not free the carrier from responsibility to anyone who bought or received the original negotiable bill for value and did not know about the court case or the delivery.
