The Director of National Intelligence must order every agency to start a stronger security review program for people who can see classified information or hold sensitive jobs. The program must begin no later than the earlier of: 5 years after the Intelligence Authorization Act for Fiscal Year 2016 was enacted, or the date the backlog of overdue periodic reinvestigations is cleared, as the Director decides. The program will pull together relevant information from government records, public sources, commercial databases, consumer reporting agencies, social media, and other sources the Director allows. That information may include criminal or civil case records, financial and credit data, public material that suggests risks like blackmail or foreign allegiance, and terrorist or criminal watch list data. Agency heads must run automated checks at least twice every 5 years, using random or aperiodic timing so each covered person gets at least two reviews in each 5-year period after the program starts. Reviews can’t be done until 120 days after the person is notified. If a check finds concerning information, the agency head must act. Agencies must tell covered people what to report. Agencies keep authority to weigh information, and the President can require broader reinvestigations. These reviews are in addition to investigations under section 3001 of the Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C. 3341). Definitions: "agency" — meaning in section 3001 of IRTPA; "consumer reporting agency" — meaning in section 603 of the Fair Credit Reporting Act (15 U.S.C. 1681a); "covered individual" — an agency employee or contractor eligible for classified access or a sensitive position; "enhanced personnel security program" — the program the Director orders.
