Post public lists and related documents about certain referrals and reports. For noncriminal referrals under section 1213(c), the Special Counsel must post the referral, the information sent to the agency, the agency’s report, any complainant comments if allowed and consented, and the Special Counsel’s comments or recommendations. The office must also post lists and agency certifications for referrals under section 1215(c)(2) and section 1214(e), and reports under section 1213(g)(1). Before posting anything, the Special Counsel must make sure not to include information that law or an Executive order says must stay secret for national defense or foreign affairs.
