If you took a voluntary separation incentive payment and then accept a paid job with the U.S. Government within 5 years of leaving, you must pay back the full payment before your first day on the new job. For that repayment rule, “employment” counts personal services contracts with the Government (except for the legislative branch). For the rules that allow waiving repayment, “employment” does not include those contracts. The Director of the Office of Personnel Management can waive the payback for executive agencies (not the Government Accountability Office, United States Postal Service, or Postal Regulatory Commission) if the agency head asks and the person has special skills and is the only qualified applicant, or if there is an emergency that threatens life or property and the person’s specific skills are needed temporarily. For the legislative branch, the head of the entity or appointing official can waive repayment if the person is uniquely qualified and the only applicant. For the judicial branch, the Director of the Administrative Office of the U.S. Courts can waive repayment if the person is uniquely qualified and the only applicant.
