Agencies must set the basic pay for their administrative appeals judge positions that mostly review decisions by administrative law judges under section 3105, and that are not classified above GS–15 under section 5108. "Agency" means an Executive agency under section 105, excluding the Government Accountability Office. Pay must follow rules the Office of Personnel Management (OPM) makes and must be no lower than the AL–3 minimum and no higher than the AL–3 maximum in section 5372.
