Title 5 › Part PART I— - THE AGENCIES GENERALLY › Chapter CHAPTER 5— - ADMINISTRATIVE PROCEDURE › Subchapter SUBCHAPTER III— - NEGOTIATED RULEMAKING PROCEDURE › § 564
If an agency decides to set up a negotiated rulemaking committee, it must publish a notice in the Federal Register and, if needed, in trade or other special publications. The notice must say it plans to form the committee, describe the rule topic and key issues, list the interests likely affected, name the people proposed to represent those interests and the agency, give a proposed agenda and schedule (including a target date to publish a proposed rule), describe what help the agency will give the committee (like technical support), and tell how to comment or apply for committee membership. People who will be significantly affected and who think they are not properly represented can apply or nominate someone. Applications must give the applicant’s name and the interest they would represent, proof they can represent those parties, a written promise to take part in good faith, and an explanation why the named representatives do not adequately speak for them. The agency must allow at least 30 calendar days for comments and applications.
