OPM can let an agency give a pay boost to a General Schedule (GS) supervisor who manages one or more non‑GS employees when those workers would otherwise be paid more than the supervisor. When making that comparison, OPM rules may count extra pay like comparability payments under section 5304, other differentials, and allowances that are not part of basic pay. The boost may be a percent of the supervisor’s basic pay (not including section 5304 comparability pay) or a flat dollar amount. It cannot make the supervisor earn more than 3 percent above the highest‑paid subordinate. The boost is not part of basic pay, and cuts or removals cannot be appealed, but this does not remove rights under subchapter II of chapter 12 or the laws listed in section 2302(d). The boost is paid with regular pay. OPM will write rules to run this program. Definitions: “agency” and “employee” — see section 5102; “employee under the General Schedule” — a position covered by subchapter III of chapter 53.
