Every October and April, each federal agency must publish a regulatory flexibility agenda in the Federal Register. The agenda must give a short description of any rule the agency expects to propose or create that could have a big economic effect on a substantial number of small entities (like small businesses). It must also give a brief summary of each such rule, explain the rule’s goals and legal basis, give an estimated timetable for rules where a general notice of proposed rulemaking has been issued, and list the name and phone number of an agency contact who knows about the items. Each agenda must be sent to the Chief Counsel for Advocacy of the Small Business Administration for any comments. Agencies must try to notify small entities or their representatives directly or by publishing the agenda where those groups will see it, and they must invite comments. Agencies may still consider or act on matters not listed in the agenda, and they are not required to act on items that are listed.
