Tell how to figure the monthly or weekly pay used to set disability or death payments for federal employees. Overtime pay means pay for hours worked beyond the basic workweek set by the employer. Year means 12 calendar months or the equivalent the Secretary of Labor allows. Monthly pay at the time of injury is one-twelfth of the employee’s average annual earnings. Weekly pay is one-fifty-second of that average. For a period of total disability up to 90 calendar days from when the disability starts, the Secretary of Labor may choose to use the worker’s actual daily wage and pay for the days the worker would have worked. Average annual earnings are found this way. If the worker held the same job for most of the year before the injury and had a fixed annual pay, use that yearly rate. If the annual pay was not fixed, multiply the daily wage (or its average if it changed) by 300 for a 6-day week, 280 for a 5½-day week, or 260 for a 5-day week. If the worker did not work most of the year but the job would have been year-round, use the average pay of similar workers in the same place. If neither method fits, pick a reasonable annual amount based on the worker’s and similar workers’ past federal pay, but never less than 150 times the average daily wage earned in the year before injury. For unpaid or nominal-pay service, apply these rules as best as possible, but do not exceed the GS–15 minimum pay rate; if you still can’t decide, use a reasonable value not over $3,600 a year. Include the money value of food, housing, other in-kind pay you can value, and certain premium pay under section 5545(c)(1). Do not count overtime, overseas cost-of-living or special allowances, or special wartime or hazardous-service bonuses.
