If annuity payments are later denied, the person (or their survivor or beneficiary) does not have to give back any annuity money that was properly paid and that is more than the total the person put into the annuity plus any interest that applies. If retired pay is later denied, the person — including eligible beneficiaries under chapter 73 of title 10 or section 5 of the Uniformed Services Contingency Option Act of 1953 (67 Stat. 504) — does not have to repay retired pay that was properly paid even if it violated this subchapter.
