Title 50 › Chapter CHAPTER 32— - CHEMICAL AND BIOLOGICAL WARFARE PROGRAM › § 1512a
The Secretary of Defense must not move any chemical munition that was part of the government’s chemical weapons storage out of the State where it was located on October 5, 1994. If a munition was not in any State on that date, the Secretary must not move it into a State. If the Department of Defense finds or takes control of chemical munitions that are not part of that stored stockpile, the Secretary may send them to the nearest storage facility that has the needed permits, but only if the Secretary believes the move is necessary and it can be done without harming public health or safety.
