§1543a Report on hostilities involving United States Armed Forces

Summary

The President must send a report within 48 hours to the congressional defense committees, the Senate Committee on Foreign Relations, and the House Committee on Foreign Affairs after any incident where U.S. Armed Forces are involved in an attack or hostilities. The President does not have to send the report if the incident was already reported under section 1543 within 48 hours, or if the President had already told Congress under section 1549 that the forces were acting under a specific statutory authorization described in section 1544(b). The report must say the legal authority the forces were using, the date, place, how long the incident lasted, and who else took part. It must describe the U.S. forces and their mission, give the numbers of combatant and civilian casualties, and include any other information the President thinks is appropriate.

(a)Not later than 48 hours after any incident in which the United States Armed Forces are involved in an attack or hostilities, whether in an offensive or defensive capacity, the President shall transmit to the congressional defense committees, the Committee on Foreign Relations of the Senate, and the Committee on Foreign Affairs of the House of Representatives a report on the incident, unless the President—
(1)otherwise reports the incident within 48 hours pursuant to section 1543 of this title; or
(2)has determined prior to the incident, and so reported pursuant to section 1549 of this title, that the United States Armed Forces involved in the incident would be operating under specific statutory authorization within the meaning of section 1544(b) of this title.
(b)Each report required by subsection (a) shall include—
(1)the authority or authorities under which the United States Armed Forces were operating when the incident occurred;
(2)the date, location, and duration of the incident and the other parties involved;
(3)a description of the United States Armed Forces involved in the incident and the mission of such Armed Forces;
(4)the numbers of any combatant casualties and civilian casualties that occurred as a result of the incident; and
(5)any other information the President determines appropriate.

Delegation of Authority Under section 1230 of the National Defense Authorization Act for Fiscal Year 2024 Memorandum of President of the United States, Feb. 16, 2024, 89 F.R. 13261, provided: Memorandum for the Secretary of State[,] the Secretary of Defense[, and] the Attorney General By the authority vested in me as President by the Constitution and the laws of the United States of America, including section 301 of title 3, United States Code, I hereby delegate to the Secretary of Defense, in consultation with the Secretary of State and, as appropriate, the Attorney General, the authority to transmit to certain congressional committees the report required by section 1230 of the National Defense Authorization Act for Fiscal Year 2024 (Public Law 118–31) [50 U.S.C. 1543a].
