The Secretary must sell crude helium from the Federal Helium Reserve in amounts and at times that avoid sudden market harm, and never below a yearly minimum price. From October 1, 2014 until the government’s recoverable supply (not counting privately stored amounts) drops to 3,000,000,000 standard cubic feet, the Secretary will auction part of the helium: 10% of the yearly volume in fiscal 2015; then each year from 2016 to 2019 increase the auction share by 15 percentage points over the prior year; and starting in fiscal 2020 offer 100% at auction. The Secretary can lower or raise those auction amounts to prevent market damage or to get better returns, but must explain cuts to congressional committees. The Secretary sets annual minimum sale and auction prices using auction results first, then independent survey and transaction and cost data. Companies that deal with the Reserve must give confidential data on volumes, prices, refinery costs, and capacity. Refiners must make any extra refining capacity available at commercial rates to auction winners and buyers who bought crude directly from the Secretary. The Secretary may run a forward auction of up to 10% of next year’s auction volume starting in fiscal 2016 if it meets certain tests. Special rules require one auction and one sale in 2015 (with set payment deadlines) and one one-time sale of at least 250 million cubic feet by August 1, 2014. When helium is sold, all money goes into the Helium Production Fund. That fund pays for maintenance, upgrades, drilling, and other costs of the Helium System. Any extra money goes to the Treasury’s general fund to help reduce the federal deficit, and $51,000,000 of those transfers must be used to retire public debt. The Secretary must report yearly to Congress on all related spending. Each year the amount offered can’t exceed either what was offered in fiscal 2012 or the system’s maximum production capacity.
