You can choose to take a smaller retirement payment so a former spouse you had on November 15, 1982 can get a survivor annuity. If you were not retired by November 15, 1982, you can make this choice any time before you retire. If you already were retired by that date, you must make the choice within the time the Director sets. The choice is treated the same as other spousal agreements under the system. The survivor annuity can cover all or part of the portion of your annuity not already set aside for a current or another former spouse. The size of the reduction follows the system’s existing rules. If you make the choice before retirement, the reduction starts when your annuity starts. If you were retired by November 15, 1982, the reduction is effective November 15, 1982.
