Put Agency employees whose service after December 31, 1983 counts for Social Security and Medicare under the Federal Employees’ Retirement System (FERS), unless an exception applies. Workers who were in the Agency’s older retirement system on or before December 31, 1983 and who have not had a break in service longer than one year since then stay in the old system and are not moved to FERS. Also excluded are people who left Federal service after being Agency retirement-system employees and Agency employees with at least 5 years of civilian service before January 1, 1987 that counts under the old system. Those excluded may be treated as such under FERS rules or may choose to join FERS if allowed by the regulations. An employee designated as a participant after December 31, 1987 may elect to join FERS only within the six-month period after that designation. The election takes effect the first pay period after it is made and cannot be changed. Applying FERS to these Agency employees follows the special rules in this subchapter, and those special rules override any conflicting FERS provisions.
