The Director of National Intelligence must appoint a Civil Liberties Protection Officer who reports directly to the Director. The officer must make sure civil liberties and privacy are part of policies for the Office of the Director of National Intelligence and the intelligence agencies covered by the National Intelligence Program. The officer watches for legal compliance with the Constitution, laws, regulations, and executive orders. The officer reviews complaints about privacy or civil liberties, investigates when needed, makes sure technology protects personal data, ensures records covered by section 552a of title 5 (the Privacy Act) follow fair information rules, does privacy impact assessments when required, and does other duties the Director or law assign. The officer can send complaints to the appropriate Office of Inspector General to investigate.
