The Attorney General and other federal law enforcement leaders must quickly tell the Director of National Intelligence about foreign intelligence they learn while doing a criminal investigation. The Attorney General must make guidelines for how to do that with the Director. The Attorney General can make rules that except some kinds of intelligence or certain targets if telling would harm an ongoing investigation or other major law enforcement interests. Not later than 180 days after October 26, 2001, the Attorney General, working with the Director of National Intelligence, must make rules so that when the intelligence community reports possible criminal activity by a foreign intelligence source, the Attorney General tells the Director, within a reasonable time, whether to begin or decline to begin a criminal investigation. The Attorney General must also set up procedures for how agencies will follow these rules and give notices.
