The Director of the National Reconnaissance Office, working with the Director of National Intelligence, may keep certain NRO “operational files” private and not follow the usual public-records rules (FOIA) about publishing, giving out, searching, or reviewing them. Operational files are the NRO records that show how foreign intelligence or counterintelligence is gathered by scientific and technical systems. Files that only hold already-shared intelligence are not counted as operational files. Even if kept private, those files must still be searched or reviewed when a U.S. citizen or lawful permanent resident asks for their own records under the public-records or privacy laws, when the existence of a special activity is not itself secret, or when specific investigations are opened by oversight bodies, including both congressional intelligence committees, the Intelligence Oversight Board, the Department of Justice, NRO legal offices, the Director’s office, or the NRO Inspector General. If non-exempt files contain material from exempted operational files, those non-exempt files must be searchable. Moving, returning, or partly declassifying material does not automatically remove the exemption, except in some returned-record cases. People denied records can sue under FOIA rules, but courts use special, mostly written procedures to handle secret material (including closed, in‑camera review and limits on discovery). The NRO and the Director of National Intelligence must review these exemptions at least every 10 years (counting from November 27, 2002), consider public interest and declassification potential, and get DNI approval to remove an exemption. Courts hearing a challenge may only review whether the required 10-year review happened and whether the right factors were considered.
