When an agency head sends a plan to the Director of the Office of Management and Budget under section 124 of OMB Circular A‑11 (or any later circular that asks for a plan for an orderly shutdown when there is no funding), that head must also give a copy of the plan to certain Congress committees: the congressional intelligence committees; the Senate Appropriations Committee’s Defense Subcommittee; the House Appropriations Committee’s Defense Subcommittee; and, if the plan is for an intelligence unit inside the Department of Defense, to the Senate and House Armed Services Committees. “Head of an applicable agency” means the Director of National Intelligence, the Director of the Central Intelligence Agency, and each head of an intelligence element that is inside the Department of Defense.
