The President must create, within 180 days after March 15, 2022, a set of uniform health protocols for the intelligence community. These protocols must be reviewed from time to time and follow the law and current medical practices. They must cover: voluntary baseline medical testing for covered employees, covered individuals, and dependents on overseas travel orders (for example lab tests, vision and hearing checks, brain-injury and balance/cognition assessments, medical history, and other standard exams); voluntary testing and coordinated treatment after reported anomalous health incidents (including special rules for children, timely access to cleared and child-expert clinicians, options for psychological care, and the ability to compare post-incident samples to a person’s baseline if available); rules for collecting, storing, and protecting information; and a system for reporting incidents and handling complaints about medical care. Any data collected under these protocols cannot be used for research or analysis unless the person gives written consent. Not later than 180 days after March 15, 2022, the Director of National Intelligence must send a report to the appropriate congressional committees that includes copies of the protocols, a description of needed interagency agreements or authorities and any new facilities, equipment, training, or other resources, and a timeline with priorities for who will get the protocols first. Not later than 60 days following the date of submission of that report, and biannually thereafter, the Director must brief those committees on implementation. “Appropriate congressional committees” means the congressional intelligence committees and the House and Senate Committees on Armed Services. “Covered employee” means an employee, assignee, or detailee of an intelligence element. “Covered individual” means a contractor. “Dependent” means a family member (including a child) as defined by the Director of National Intelligence. “Victim of an anomalous health incident” means someone covered who is, or may be, affected by such an incident.
