By February 1 each year, the head of every covered element must send the four leaders of Congress a report on each covered program they run. The report must say how much money the element asked for those programs in the budget it files under section 1105 of title 31 for the next fiscal year. For each program the report must give a short description, and for procurement programs a short list of major milestones. The report must list the actual cost for every past fiscal year the program ran before the budget year. It must also give the program’s estimated total cost and estimated costs for the current fiscal year, the budget year, and each of the four following fiscal years. For any new covered program, the report must also say if it is being treated as a special access program, explain why, give the current estimate of total cost, and note any similar programs or technologies. If a program’s classification will change or be declassified and made public, the head must report the planned change, the reasons, and any planned public announcement. That report must be sent at least 14 days before the change, unless exceptional circumstances prevent that — in which case the report must be sent any time before the change with an explanation. If the rules used to call something a covered program are changed or ended, the head must promptly tell congressional leaders and explain the reasons and new rules. A covered program cannot start until congressional leaders are notified and 30 days have passed, and no money may be spent until the head briefs those leaders. Covered element = any federal part not listed in section 3348(g), not the Department of Defense, not the National Nuclear Security Administration, and not an intelligence community element. Congressional leadership = the Senate majority leader, Senate minority leader, House Speaker, and House minority leader. Covered program = any special access or similarly protected program under Executive Order 12356 or a similar authority.
