The Secretary of Defense may set up a personnel system called the Senior Cryptologic Executive Service for senior civilian staff at the National Security Agency. The rules must follow the Senior Executive Service rules in section 3131 of title 5 and meet job standards in section 3132(a)(2). Pay must stay between the SES minimum and maximum under section 5382 and be changed at the same time and by the same amount as SES pay. The system must cover performance reviews (subchapter II of chapter 43), removal and suspension rules (sections 3592 and 7543, with hearings or appeals run under procedures the Secretary of Defense sets), performance awards (section 5384), sabbaticals (section 3396(c)), and recertification (section 3393a). The Secretary can also apply other Title 5 rules and can appoint or promote people without using competitive service rules. The President may give ranks to members based on the Secretary’s recommendations under section 4507. The NSA Director can temporarily assign members to jobs outside NSA without them losing any status or benefits. The Secretary may create a merit pay system consistent with section 5401(a). No member may be paid more in a year than the annual rate for Executive Schedule Level I in effect at the end of that fiscal year.
